바쁜 시간을 보냈습니다.

그 중에는 

기억에 남는 기업계약서와  이메일 번역, 논문(중국어)이 있습니다.

----기업계약서 번역작업----

기업계약서의 원본 문서에 잘못된 단어가 인쇄되어 있었고 번역하는 입장에서는 

원본을 바꿀 수는 없어서

그대로 번역하는 방법을 택하였습니다.

번역작업은 상당한 집중력을 요구하는 일이고

가끔 다시 검토하여 보면

오자나 오역을 수정하는 경우가 있습니다.

그런데

기업계약서에 남은 서식을 만든 사람의 집중력의 부족의 흔적을

보니 어떤 종류의 동질감이 느껴집니다.

미국의 공증인, Notary public of United States

한국의 공증인은 변호사 중 특정한 자격을 갖춘 사람이 공증인 자격을 가질 수 있다. (예: 임명공증인은 통산 10년이상 판사 검사 변호사 등에 재직하였던 사람)

미국의 공증인은 주 정부가 임명하는 사람으로 각 주마다 자격에 대한 요건은 다르지만 한국처럼 엄격한 요건을 정하고 있지 않다.

32개 주에서는 범죄경력이 없다면 일정한 서식을 작성하여 제출하고 수수료(보증금)를 납부하면 공증인의 역할을 할 수 있다. 그러나 콜롬비아 주같은 18개의 주는 교육을 이수하거나 시험을 통과하거나 또는 두 조건을 충족하여야 공증인이 될 수 있다.따라서 공증인으로 임명 받은 주에서만 공증인의 자격이 유효하다. 물론 와이오밍주와 노스타코타 주와 같이 예외적으로 인접 주의 공증인의 역할을 인정하는 경우도 있다. 

미국의 공증인의 자격제도가 이처럼 다른 여타의 국가와는 달리 느슨하기 때문에 미국의 공증인은 법률적인 권위가 거의 없다. 즉 문서에 대하여 법률적 조언을 하거나, 문서를 작성하거나 하거나 문서를 공증할 지에 대한 법률적 지식을 제공하지 못하며( 루이지애나 또는 푸에르토리코, 플로리다는 예외이다.) 오직 공통적이며 기본적으로 제공할 수 있는 법률서비스는 중요한 문서에 서명을 할 때 증인역할을 하는 것이며 여기에는 문서의 복사본 또는 팩스전송된 문서를 확인하거나 확증하는 것이다.

미국의 공증인이 하는 역할 중 가장 일반적인 일은 작성인정서(Acknowledgement) 또는 선서진술서(Oath)에 서명하는 일이다.

미국의 공증인이 주로 서명하는 문구를 보면 그 역할에 대하여 충분히 추측하여 볼 수 있다.

미국의 공증인 제도가 한국보다는 자격요건이 낮고 자질이 낮지만 많은 법률문서들이 이러한 공증인의 공증을 거치고 있고 그로 인하여 사기나 문서위조 등이 예방되는 효과가 있는 것으로 인정되고 있다. 

따라서

한국도 이러한 간편한 절차를 거쳐서 법률문서에 대한 증인의 역할을 할 수 있는 제3의 공증제도를 고려하여야 한다.

Affidavit이란 무엇인가?

Affidavit(Sworn Statement)을 한글로 번역한다면  선서진술서, 보증서, 공증서 등으로 번역할 수 있다.

An affidavit (/ˌæfɪˈdeɪvɪt/ (listen) AF-i-DAY-vit; Medieval Latin for he has declared under oath) is a written statement of fact voluntarily made by an affiant or deponent under an oath or affirmation which is administered by a person who is authorized to do so by law. Such a statement is witnessed as to the authenticity of the affiant's signature by a taker of oaths, such as a notary public or commissioner of oaths. An affidavit is a type of verified statement or showing, or in other words, it contains a verification, which means that it is made under oath on penalty of perjury, and this serves as evidence for its veracity and is required in court proceedings.

Sworn Statement란 무엇인가?

번역문의 번역증명서는 Sworn Statement 를 첨부한다. 

대부분의 국가에서는 Sworn Statement 를 Affidavit과 

같은 효력을 가지고 있는 것으로 보아서

동일하게 처리하기도 한다.

Affidavit Definition:

A written statement of fact which has been verified as truthful by the mechanism of a solemn process before another party.

위의 정의에서도 알 수 있듯이 Affidavit 문서를 작성하는 과정에는 

제 3자의 앞에서 문서를 소리내어 읽고 서명하는 과정이 포함되어 있다. 

그러나 그러한 선서를 하고 사실을 확인했다는 내용은 문서에 표시되어 있으므로 

이러한 절차는 보통은 생략된다.  

물론 Affidavit을 작성하기 위해서는 다음과 같은 기본 개념을 이해하고 있다면

How is kimchi prepared?

To us, a meal without kimchi would be incomplete, even unthinkable. But what exactly is kimchi?

Kimchi is part of of the international family of pickled vegetables. It maybe be similar to the paocai of China. But just only say similar, not same. In all its variations, kimchi provides Koreans with essential vitamins as well as a distinctive flavor, which invariably draws a strong reaction from the first-time flavor. Distractors protest that their nostrils and taste buds are overwhelmed by the garlic and hot red pepper. Yet aficionados find the assault on their sense sheer delight, and they keep coming back for more 

 

As people seek to lend spice to their meals, kimchi is becoming known worldwide. Servicemen from West, immigrant workers, and thousands who came for the Seoul Olympics in 1988 got to taste it. As a result. in  some countries kimchi now stands on the threshold of acceptance in the realm of fast food beside such multinational fare as hamburgers, tacos, chow mein,  sushi, and hot dogs. Some non-Korean airlines serve it with their meals. 

So, How is kimchi prepared?

As vegetables are preserved in salt, they become crisper. Salt suppresses the growth of most of the harmful microorganisms and facilitates the production of useful ones. Such fermentation produces amino acids and lactic acid. so kimchi comes to have a unique taste very different from the original taste of the vegetables.

Then,

the ingredients are mixed with seasonings. It is no longer just garlic and red pepper that find their way into kimchi pots. A host of other ingredients, ranging from the mundane to the exotic, are also used-green onions, carrots, leeks, ginger, sesame seeds, pears, oysters, salted baby shrimps, chestnuts, abalone, pine nuts, seaweed and such as other not mundane sub materials, raw sea-fish, raw beef, not same as different regions.

My family prepares winter kimchi at the end of November every year. 

In the past when refrigerators were unknown, long Korean winters - with temperatures near the freezing point-necessitated the preparation of food that could last a long time. Kimchi was the answer. The making of large quantities of kimchi is called "kimjang". The season for this was from the end of November to the middle of December.

When extended families lived together, 'kimjang" could involve some 100 heads of cabbage. My family usually has made about 300 heads of cabbage. We first would make enormous other ingredients. Sometimes friends and neighbors would gather to help with "kimjang" . Absolutely, this is a big event every year we have to go thorough it.

Another factor is the climate-the amount of anthocyanin produced by the leaves depends much on the weather. Many of its hills are fostered with variety of deciduous trees, thus providing visitors an ideal environment for viewing the autumn colors.
